太陽花學運323占領行政院案，10日一審判決出爐，21名被告中魏揚等10人被判無罪，陳建斌等11人被判有罪，其中有2人提出「抵抗權」，但合議庭認為還有其他可以救濟的管道，因此不構成行使的「抵抗權」條件。而同樣因太陽花學運衍生出的318占領立法院案，北院因「公民不服從」等理由，判決林飛帆等22人全部無罪，但為何2起案件北院會給出2種不同的結果呢？
318占領立法院案中，林飛帆等人被依煽惑他人犯罪、妨害公務等罪起訴，日前一審出爐時，北院曾表示，林飛帆等人提出「公民不服從」，也就是德國的抵抗權，經蒐集資料再綜合國內外學說之下，認為本案是符合公民不服從的概念，有正當事由，不具有實質的違法性，因此判決22人全部無罪。
而當時北院也列出「公民不服從」權利必須符合七項要件，包括「抗議對象是與政府或公眾事務有關的重大違法或不義行為」、「須基於關切公共利益或公眾事務的目的」、「抗議行為須與抗議對象間具有可得認識的關聯性」、「須為公開及非暴力行為」、「須有適當性原則，即抗議手段須有助於訴求目的的達成」、「須有必要性原則，也就是沒有其他合法、有效的替代手段可以使用」、「要符合狹義比例原則，也就是抗議行動所造成的危害，須小於訴求目的所帶來的利益，且侷限於最小可能的限度」。
此次323占領行政院案中，魏揚等21名被告也有人被依煽惑他人犯罪、妨害公務等罪起訴，其中煽惑他人犯罪部分被判無罪，而妨害公務部分則有8人被判有罪，從北院的判決書羅列8人犯罪事實來看，就可以清楚得知當中不少人以暴力方式阻擋警方、破壞拒馬，還有人持棉被以蓋布袋方式罩住員警頭部施暴，這就違反了「公民不服從」中「非暴力行為」。
另外，涉犯毀損罪的許姓及李姓被告，主張自己是行使「抵抗權」，北院審理後認為不符「抵抗權」要件，判決書中也指出2名被告認為服貿協議程序不當、黑箱作業，但「服貿協議確為馬政府未經授權而私與中國暗中簽訂？」「立委確有權限得以就服貿協議進行逐條審議？哪個最便宜」「如未經立法院逐條審議，而經宣布視為審查送院存查等行為，是否確已侵害民主憲政之秩序？」北院認為這些部分都還有討論餘地。
而且許姓、李姓被告及抗議群眾當日侵入行政院的行為，是否已無其他救濟方法所進行的最後手段，這部分北院也抱持著疑問，並指出應可透過大法官釋憲程序處理爭議，「當體制內尚有中立途徑得以解決紛爭或救濟」，有需要以非法抗爭並以違法行為達到目的嗎？這也不符合「公民不服從」當中的「必要性原則」。

財政部長許虞哲11日出席財政部近一年施政報告記者會時指出，財政部絕不會像外界謠傳，做「劫貧濟富」的稅改。他強調，稅改絕對會顧慮中低稅利的人，目前將朝4大方向邁進，包括調升加值型與非加值型營業所得稅、降低綜合所得稅、調高薪資扣除額與標準扣除額，以及縮減內外資差異。
許虞哲表示，現在稅改延宕至6月，是因為委外做稅改評估的依據資料是2012-2014年，但兩稅合一可扣抵稅額減半是2015年才上路，最近2015年的稅務資料才完成整體建檔，因此將作更適合的精算、再以數據做分析。
他強調，稅改是整體的、絕非單面向，因此目前還無法告訴大家4大方向的調整幅度跟確切的提交草案日期；不過他透露，內外資平均稅率分別為49.8%、33.6%，差距高達16.2%是相當嚴重的問題。
日前中華財政學會受財政部委託製作稅改方案試算報告，共提出11種方案，學者建議第2、第7方案，而立委則謠傳財政部因考量稅損最小而鍾情於第11方案。許虞哲表示，雖然稅改有11個方案，但不可能在其中挑1個直接做，還需要後續的配套考量、小幅修改，以及考慮租稅公平跟稅制簡化，他承諾，財政部不會做出外傳「劫貧濟富」的稅改。
